APPEAL IN DOUBLE BENCH AGAINST DECISION OF JUSTICE TRIPATHY ON 53rd TO 55th BPSC PT EXAM

HC order to review BPSC prelims paper

Patna, Jan. 4: The high court today set aside the preliminarytest results of the 53rd to 55th common combined competitive examination conducted by Bihar Public Service Commission (BPSC) in 2011 and directed it (commission) to publish fresh result of unsuccessful candidates after re-evaluating their papers.
A bench of Justice Ajay Kumar Tripathi directed the commission to re-evaluate the papers of the unsuccessful after deleting the nine questions found to be wrong by an expert committee constituted by theBPSC in accordance with the court’s directive in September last year.
The court made it clear that the 15,137 candidates declared successful in the preliminary test by BPSC on July 16,2011, should not be disturbed while re-evaluating the papers.
The bench passed the judgment on a bunch of petitions filed byunsuccessful candidates of the preliminary exam, challenging the BPSC’s decision to announce the results of the test abruptly deletingeight marks from 150. During the course of hearing, the commission admitted that nine questions out of 150 were wrong.
Petitioners’ counsel Manan Kumar Mishra, who expressedunhappiness over the judgment, told The Telegraph: “We willchallenge the judgment in division bench seeking direction forreducing the nine marks from the current merit list in all thecategories. We will file the petition tomorrow in the high court.”
Mishra, during the hearing, advocated reducing nine marks of each candidate and prepare a fresh merit list. But the court rejected the contention.
Citing the civil judge (junior division) exam in which the same situation had arisen when commission arbitrarily reduced 25 marks but the division bench directed to reduce cut-off marks in each category by another 25 marks, Mishra had sought the same relief.
Additional advocate general (1) Lalit Kishore told The Telegraph that the court had agreed to our contention, wherein thecommission had submitted during the hearing that it was ready to carry out re-evaluation after deleting nine wrong questions. The court has taken care of the successful candidates’ fate as there would be no re-evaluation of their answer-sheets.”
An advertisement for BPSC preliminary exam was published on January1, 2011. The preliminary exam was conducted on April 17. The result was published on July 16, 2011. Of 1,37,694 candidates, about 15,137 candidates were declared successful by the commission that organised combined (53rd to 55th) civil services examination.
Several candidates who failed to make it to the list approached thecourt on the issue. The petitioners said the commission had illegally deleted eight questions out of 150 asked in the exam and declared results on the basis of 142 questions.
The petitioners maintained that they would have automatically qualified in the examination if the results were declared on the basis of 150 questions. The petitioners claimed that the answer booklets supplied by the commission had several defects. The multiple choices (answers) given against some questions were totally wrong but the commission published the result on the basis of such erroneous questions and answers, they said. They maintained that the act of declaring results on the basis of only 142 questions instead of 150 by the commission was totally arbitrary, illegal and mala fide.

PATNA HIGH COURT DECISION ON 53rd TO 55th BPSC PT EXAM

Patna high court announced its much awaited decision on the 53rd to 55th PT examination of BPSC ,the decision had been kept pending since last December. In his decision justice Tripathy directed BPSC to reevaluate copies of PT examination. No deduction in cut off marks will be done as it was anticipated earlier, that court may ask to decrease cut off marks by one or two marks. However giving a big relief   to those candidates who has been declared qualified earlier, court ordered  BPSC to exempt them from reevaluation process  it means only new candidate will be declared qualified without altering status of previously qualified candidates.Estimated 588 more candidate is likely to be declared  qualified.BPSC has been given own choice to conduct mains exam,it is possible in April 2012 because in feb, march there is 10th and 12th exam in bihar of bihar board and CBSE .To see court order please http://patnahighcourt.bih.nic.in/judgment/pdf.aspx?ord=7&noc=15&caseno1=13022&yr=2011

FIRST CHELLANGE TO NANO,Bajaj Unveils RE60

TATA NANO  the only available car below 2 lac has got its first rival.having given a tough fight to HERO HONDA in bike segment  Bajaj Auto has unveiled its RE60 4-Wheeler in New Delhi. The Bajaj RE60 has the lowest CO2 emissions of 60 g/km. It is why the name RE60 has been given to this car.The company claims a mileage of 35 kmpl and the RE60 will hit a top speed of 70 kmph. The tall boy design looks funny and the RE60 is more of a 4-wheeled rickshaw than a car. The front seems to be inspired from the Fiat Uno, while the overall body looks like that of a small Maruti Suzuki WagonR. The Bajaj RE60 offers 2+2 or 1+3 seating and has the speedometer in the center of the dashboard, right above the center console. The vehicle has a single wiper and runs on 135/70/12 tyres. With a weight of just 400 kgs, the RE60 is very light and will also be offered in a CNG version. Bajaj will offer 2 variants of the RE60, a commercial variant and a private variant. The vehicle will be made at Bajaj Auto’s Aurangabad plant.

Bajaj has developed an all new 200cc (some sources claimes it to 800)petrol engine to power the RE60, which is Euro IV compliant. This new petrol motor is a fuel injected (uses a close-loop fuel injection system), water cooled unit, using 4-valve and twin spark technology producing 20 BHP of power. The sequential transmission is easy to use. The mono coque metal polymer hybrid structure is light weight and results in the low weight. The length is 2752mm, the width is 1312mm, while the height is a generous 1650mm. The RE60 has 44-liter of rear boot storage, 7-liter under the hood and 400 liters with the rear seats folded down. The turning circle is very small at just 3.5 m (the Tata Nano has a turning circle of 4 m).

Maruti industries who is already facing sinking market share now get another challenge in form of Bjaj RE60.  Bajaj will commence sales by exporting the RE60 to Sri Lanka. Bajaj has used existing plant to save Rs. 350 crore on the RE60 project. This 4-wheeler is still open for Renault-Nissan to market as their own small car.
